India: FIMI files Review Petition in Odisha High Court

Bhubaneswar: The Federation of Indian Mineral Industries (FIMI), on the behalf of the miners in Odisha, filed a review petition in Odisha High Court, on the verdict that stated compulsory sale of minerals in within the state.

On 2nd April, the Odisha High Court had to uphold Odisha Government’s 2012 order that mandated sale of 50% minerals produced in the state, to the local industries. The court has asked Odisha government to formulate a mechanism for distribution of minerals within 3 months from the order.

FIMI had filed review petition last week in the High Court arguing that the court has asked the state government to form a mechanism within 3 months, which mean it has accepted that there is no mechanism for distribution of Iron ore and other minerals. Thus, the whole order itself is defective.

Last month FIMI indicated that it’ll escalate to the Supreme Court with an appeal against Odisha High Court order.

The interpretation of High Court regarding Mineral Concession Rule (MCR) is not correct. We will go to Supreme Court against the decision of the High Court as we feel the notification is invalid,” R K Sharma, Secretary General of FIMI, said last month.
