OMC yet to take any decision of the penalty notice 

Bhubaneswar:
While the private miners have threatened to go to court over the penalty notice,
the Odisha government controlled miner Odisha mining Corporation (OMC) is yet
to take any decision on the issue.

“We are yet to
take any decision on this. But we have time and we’ll clear our position only
after sending our reply on the notice to the department of mines” said Saswat
mishra,CMD, OMC to media persons.

It may be noted
that, the department of mines has send as many as 27 mining companies both in
the private and government sector in the Joda mining circle. The government
miner OMC has got a penalty notice of Rs. 1945 crore 21 lakh 14 thousand 651. The
department has sent notices under the provisions of 21(5) of the MMDR act 1957.
However, the mining controller Indian Bureau of Mines (IBM) has countered that
this is not a case of illegal mining and can be termed as irregular mining.

While
law-experts say these penalty notices are not legally tenable, the private
miners like Tata Steel have given enough indication to contest it.
