India: Odisha High Court Order on 50:50 Rule expected Soon

Reserving 50% of ore for local industries, the Odisha High Court may pronounce verdict soon.

Bhubaneswar: The Odisha High Court may pronounce its verdict on 50:50 order of the Odisha Government , which mandates to reserve 50% of the Iron ore produced for the inside state industries, within next couple of weeks.

On 5 Dec, 2012 the Odisha Government had come up with the regulation which has asked the merchant miners to sale 50% of ore to state based industries. Meanwhile, the captive miners were excluded from the order.

“The hearing of the case was concluded on 6 Mar, 2014 and the court has reserved its judgment for a later date. We are expecting the verdict to come within 2 weeks”, said PL Kandoi, President of All Odisha Steel Federation (AOSF).

However, the miners have been opposing the regulation saying that it is restrictive and there is no such provision in the MMDR or MCR act. Subsequently, the miners under the banner of Federation of Indian Mineral Industries (FIMI) had moved to the Odisha High Court.

There is a mixed response for this rule among the steel makers all across India. Manufacturers which are located in the state are quite happy with the existing rule. However, manufacturers located outside the state blame that this is illegal and requirement within the state is considerably very low.
