The Supreme Court has struck down the integrated goods and services tax (IGST) levied on ocean freight as charging IGST again on freight amounts to double taxation, which is unconstitutional. An importer pays customs duty on the value (CIF) which includes cash, insurance and freight. After this order, Indian importers can save 5% IGST on ocean freight and will also be eligible for refunds in case of overpayment.
