India: SC refuses Petition to interrupt Coal Mining

Post cancellation of coal blocks, the Supreme Court has recently rejected the petition to stop continuous coal mining made by the companies.

After the cancellation of all coal blocks except 4 blocks (PSU-SAIL, NTPC JV mine and two of UMPPs), the Supreme Court in its hearing on 16 Oct, 2014 has rejected the petition filed by the Indian Adovocate, ML Sharma. In this petition, he claimed that the companies, which were given time duration of 6-month for winding up their operations, are extracting coal in huge quantity per day and also selling it in the open market.

The court stated that although the licenses were cancelled, we can’t stop the companies to extract coal within the given duration. Also, in the previous hearing, the court had not mentioned a fixed quantity for per day extraction.

At present state of affairs, India’s several power plants are facing problem related to coal stock as CIL failed to increase its output faster in order to fulfill the rising demand of power sector in India.
