Odisha Government Goes Strong on Transport Strike, Imposes ESMA

Odisha government imposed Orissa Essential Services (Maintenance) Act (ESMA) to prohibit the strikes by various transport associations.

Odisha government on Tuesday imposed Orissa Essential Services (Maintenance) Act (ESMA) to prohibit strikes by various transport associations which has paralysed mineral transport from mining areas since last 10 days. The Department of Home has issued orders in this regard, after Chief Minister Naveen Patnaik cleared the proposal of the Department of Steel & Mines (DoSM), officials say.

Any service connected with transportation of persons/goods is defined as essential service under Section 2(a)(iv) of the Orissa Essential Services (Maintenance) Act, 1988. “The state government has taken action to prohibit the strike called by the Associations of the Truck Owners under Section 3 of the Orissa Essential Services (Maintenance) Act, 1988 in the Public Interest in the State,” said an official. Department of Home is entrusted to implement the ESMA as and when situation arises in the state. State government has invoked Section 3 of the Orissa Essential Services (Maintenance) Act, 1988 to prohibit strike in the essential services of transportation of minerals for a period of six months.

Disruption of transportation of minerals in the state has caused immense loss to the economy of the state and it has affected the revenue collection of the state government as mining royalty from the dispatched minerals. Production of minerals has been severely affected and end users are facing tough time due to such an impasse.

State government after receiving reports of obstruction of mineral transportation by the Truck Owner Associations of Keonjhar and Sundargarh since 20 July, has taken the drastic step to promulgate ESMA in the entire State. The transporters are opposing the government decision to cap mineral transport rates.
