Stay continues on Odisha Government’s Decision on Auction of Mines, Next Hearing on 29th April

Bhubaneswar: The Odisha High Court on Wednesday upheld the interim stay order on state cabinet’s decision to auction of non-coal mines and directed the state government to file replies in this regard April 27.

Market experts anticipate, the Odisha High Court may ask the state government to allow operation of lapsed mine leases in line with the provisions of the Mines and Minerals (Development and Regulation Amendment) Ordinance, 2015.

A bench of justices Indrajit Mohanty and BK Nayak gave the direction as the Odisha government could not file report in this regard during the hearing and sought more time. The court will take up the case for hearing on April 29.

It may be noted that the Odisha cabinet on 5th of January has taken a decision to auction all the lapsed mining leases, just before MMDR amendment ordinance was signed by the president on 12th January. Recently MMDR act has been passed by the upper house of the parliament.

 

However, several miners including Mideast Integrated Steel ltd,Odisha Manganese and Minerals,Aryan Mining,Kalinga Mining Corporation have challenged the cabinet decision in the High Court.
