Karnataka Government brings out new draft rules with heavy penalty to prevent illegal mining

Karnataka State Government has brought out new draft rules with tougher penal provisions – levy of penalty ranging from Rs 10,000 to Rs 25,000, with one-year imprisonment to prevent illegal mining in the state..*

 

Following a Supreme Court directive which is hearing special leave petitions filed by miners challenging the iron-ore transportation ban, the state government has published draft rules to prevent illegal mining, transportation and storage of minerals. 

 

The draft of Karnataka (prevention of illegal mining, transportation and storage of minerals) rules, 2011 seeks levy of penalties, one-year imprisonment for overloading and makes it compulsory for vehicles carrying ore to have GPS. 

 

As per the draft rules, minerals have to transported under a valid permit only- the mineral dispatch permit (MDP). One permit will be issued for each vehicle for a single trip. In case of forest-based mining leases, MDPs will be issued after receipt of forest-way passes. 

 

The MDP’s validity period is based on the distance from the mine to the destination by road. If the distance is up to 100 km, the validity is for one day; between 100 and 500km it is one day for every distance of 100km; beyond 500km it is a maximum of eight days. If the mode of transportation is by rail, the validity is for a maximum of 15 days.
