With the intent of protecting the atmosphere in the Delhi/NCR from the pollution caused by the emission of Sulphur during burning of Petcoke in industrial units, the Ministry of Environment, Forests & Climatic Change (MoEF&CC) has dictated the following measures to be followed during buying, selling and using Petcoke in Delhi/NCR:
1. No cement plant in the Delhi/NCR region can use Petcoke as a fuel without the consent as well as the registration with the concerned State Pollution Control Boards.
2. The consent to be given by the concerned State Pollution Control Boards will specify the quantity of Petcoke permitted to be used per month/annum against the quantity of products to be produced.
3. Industrial units will not be permitted to store Petcoke in excess of its consumption for three months.
4. Refineries, the Petcoke producers, and the authorized dealers and users of Petcoke in Delhi/NCR will have to be registered with the respective State Pollution Control Boards.
5. Refineries and the authorized dealers will be able to sale Petcoke to the industrial units only the permitted quantities by the respective State Pollution Control Boards.
6. Refineries should follow only two ways of selling Petcoke to the industrial units—from refinery to the industrial unit; or from refinery to authorized dealer to industrial unit.
7. Only permitted and registered industrial units in the Delhi/NCR will be allowed to import Petcoke, and the consignments should be in the names of the units and should be for own use.
8. Importing Petcoke for trading in Delhi/NCR will not be permitted.
9. Refineries and the authorized dealers should submit details of Petcoke produced and sold to industrial units every month; and the monthly opening as well as closing stocks to the respective State Pollution Control Boards.
10. All end user industrial units (including refineries) should submit details to the respective State Pollution Control Boards of the Petcoke purchases (self-produced, imported, purchased from refineries/authorized dealers), consumption and, opening and closing stocks every month.
11. The State Pollution Control Boards will develop electronic systems for uploading consents, registration, sales record by refineries, usage record by industrial units; and the data will be shared with the Central Pollution Control Board on quarterly basis.
12. Industrial units will have to procure Petcoke only from refineries and the authorized dealers; and not from any intermediary either in or outside the Delhi/NCR.
13. Refineries and the authorized dealers outside the Delhi/NCR that will sale Petcoke to user industries in the Delhi/NCR will have to be registered with the respective State Pollution Control Boards in their states. Moreover, the directives in (4), (5) , (6) and (9) should be followed.
